Most criminal prosecutions for resisting arrest and assault and battery on a police officer are really “frame-ups” by the police.

 Police officers commonly abuse the criminal justice system by trying to frame their victims, because if they are successful, the victims are usually precluded from suing the police. They file false police reports with the District Attorney’s office, and conceal or destroy important evidence. The police usually get away with their frame-ups because the District Attorney’s Office is usually all too willing to protect the police, and because:

1. Most criminal lawyers don’t know what evidence is available to them, like civil rights lawyers do, and therefore, don’t learn much about “discovering the police”;

2. Most criminal lawyers don’t know about making sure that important evidence, like audio recordings of police radio transmissions and telephone communications, and police car video recordings, are preserved; for both the defense of the criminal case, and for the prosecution of the civil case;

3. Most criminal lawyers don’t understand that bringing (and losing) a motion to suppress (exclude from trial) illegally obtained evidence, can result in their clients being later precluded from suing the police for excessive force, false arrest of malicious prosecution; even if they ultimately win the criminal case; and

4. Most criminal lawyers do not know what needs to be done in a criminal case to maximize a criminal defendant’s chances winning the criminal case, and then prevailing on a subsequent civil action against the police.
